I. General information
1. The operator of the website www.malkowski.pl is Małkowski-Martech S.A. with headquarters in Czołów, ul. Leśna 57, 62-035 Kórnik, entered into the Register of Entrepreneurs kept by the District Court in Poznań, IX Commercial Division of the National Court Register under KRS number: 0000350585; NIP: 1230029611; REGON: 006372010 (hereinafter referred to as: "Małkowski-Martech").
2. The website performs the functions of obtaining information about users and their activity in the following ways:
a) by saving information provided by website users voluntarily in the forms provided on the website,
b) by using cookies saved in end devices,
c) by profiling.
II. Information obtained in forms
1. The website collects information provided voluntarily by the user.
2. In addition to the information referred to in par. 1, the website saves information about connection parameters: connection time, user's IP address.
3. The scope of data collected in the forms and the purpose of their processing depend on the function of a specific form (e.g. newsletter subscription form, contact forms, registration form for setting up an account, product inquiry forms, etc.)

3. In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (Journal EU L 119 of 04/05/2016, p. 1) (hereinafter referred to as: "GDPR") personal data of website users are processed:
a) pursuant to art. 6 sec. 1 lit. a) in connection with art. 22 sec. 2 lit. c) GDPR for the purpose of automated decision making based on profiling for the best matching of advertisements and presented content to the individual needs of the user - until the consent is withdrawn;
b) pursuant to art. 6 sec. 1 lit. a) GDPR, i.e. voluntary consent expressed by you, under the appropriate form - for the purpose resulting from the function of a given form (e.g. sending a newsletter, handling a product inquiry, making contact) - until the activities resulting from the function of a given form are completed or until withdraw the consent given;
c) pursuant to art. 6 sec. 1 lit. f) GDPR in order for the administrator to pursue possible claims related to the handling of notifications sent via contact forms and to conduct marketing activities promoting the administrator's activity, including the use of e-mail addresses and telephone numbers - until an objection to data processing is raised on this basis.
4. Website users, in connection with the processing of their personal data, have the following rights:
a) the right to access your data - in accordance with art. 15 GDPR,
b) the right to rectify your data - in accordance with art. 16 GDPR,
c) the right to delete data (the so-called "right to be forgotten") - in accordance with art. 17 GDPR,
d) the right to limit data processing - in accordance with art. 18 GDPR,
e) the right to transfer data - in accordance with art. 20 GDPR,
f) the right to withdraw the consent at any time (without affecting the lawfulness of the processing carried out on the basis of the consent given before its withdrawal) - in accordance with art. 7 sec. 3 GDPR
5. The website users also have the right to object to the processing of their personal data pursuant to Art. 6 sec. 1 lit. f GDPR.

The website user also has the right to lodge a complaint with the President of the Personal Data Protection Office if it is found that the processing of their personal data by Małkowski-Martech violates the provisions of the GDPR, the Act of May 10, 2018. on the protection of personal data (Journal of Laws of 2018, item 1000, as amended) and any other national regulations used to apply the GDPR.
7. Personal data of website users may be transferred to the following recipients:
a) entities from the ASSA ABLOY AB group based in Stockholm (Sweden), including Assa Abloy Opening Solutions Poland S.A. with headquarters at ul. Magazynowa 4, 64-100 Leszno.
b) other entities cooperating with Małkowski-Martech in the implementation of the purposes of processing referred to in paragraph 3.
8. In the event of consent, the user's personal data will be processed by Małkowski-Martech on the basis of automated decision-making, including profiling. Technologies that store and gain access to information stored on the user's end devices (in particular using cookies) allow Małkowski-Martech to evaluate user activity and on its basis adjust advertisements and content presented on the website to the individual preferences of each user. 9. Providing data via the forms on the website is voluntary, but necessary to use the functionality of individual forms.
10. Małkowski-Martech does not transfer users' personal data to third countries (ie outside the European Union or the European Economic Area) or to international organizations.

3. The administrator processes personal data:
1) Clients:
a) pursuant to art. 6 sec. 1 lit. b) GDPR - in order to take steps to conclude a contract and perform concluded contracts (including telephone and e-mail contact, sending documents related to the services provided and others) - until the contract is performed;
b) pursuant to art. 6 sec. 1 lit. c) GDPR - in order to fulfill the obligations incumbent on the Administrator under applicable law, including in particular obligations arising from tax law - until the obligations are fulfilled or expire;
c) pursuant to art. 6 sec. 1 lit. f) GDPR - for purposes resulting from the legitimate interests pursued by the Administrator, including in particular to investigate, establish and defend claims, for archival and statistical purposes and for the purpose of using direct marketing - until the objection to processing is raised or until the expiry of the statute of limitations claims / existence of a legitimate interest of the Administrator;
d) pursuant to art. 6 sec. 1 lit. a) GDPR - if the appropriate consent is given for the purpose of sending commercial information and promoting own services - until the consent is withdrawn;
2) Contractors who are natural persons:
a) pursuant to art. 6 sec. 1 lit. b) GDPR - in order to conclude and implement contracts binding the Administrator - for the duration of the contract;
b) pursuant to art. 6 sec. 1 lit. c) GDPR - in order to fulfill the obligations incumbent on the Administrator under applicable law, including in particular obligations arising from tax law - until the obligations are fulfilled or expire;
c) pursuant to art. 6 sec. 1 lit. f) GDPR - for purposes resulting from the legitimate interests pursued by the Administrator, including in particular to investigate, establish and defend claims, for archival and statistical purposes and for the purpose of using direct marketing - until the objection to processing is raised or until the expiry of the statute of limitations claims / existence of a legitimate interest of the Administrator;
d) pursuant to art. 6 sec. 1 lit. a) GDPR - if the appropriate consent is given for the purpose of sending commercial information and promoting own services - until the consent is withdrawn;
3) persons staying at the Administrator's seat - pursuant to art. 6 sec. 1 lit. f) GDPR - in the form of an image recorded by the video monitoring system - in order to ensure the safety of people staying at the Administrator's premises and to protect property and to keep secret information, the disclosure of which could expose the Administrator to damage - for the period of storing recordings from the video monitoring system, no longer than 3 months from the registered event.
4. In the scope resulting from the GDPR, you are entitled to:
a) the right to access your data - in accordance with art. 15 GDPR,
b) the right to rectify your data - in accordance with art. 16 GDPR,
c) the right to delete data (the so-called "right to be forgotten") - in accordance with art. 17 GDPR,
d) the right to limit data processing - in accordance with art. 18 GDPR,
e) the right to transfer data - in accordance with art. 20 GDPR,
f) the right to withdraw the consent at any time (without affecting the lawfulness of the processing carried out on the basis of the consent given before its withdrawal) - in accordance with art. 7 sec. 3 GDPR
5. You also have the right to object to the processing of personal data pursuant to Art. 6 sec. 1 lit. f GDPR.

8. Your personal data will not be processed by the Administrator on the basis of automated decision making, including profiling.
9. The administrator will not transfer your personal data to third countries (outside the European Union or the European Economic Area) or to international organizations.
10. Personal data are provided by you voluntarily, but their provision is a requirement necessary to achieve the purposes of processing specified in par. 3.
VI. Profiling
1. The website www.malkowski.pl, if you give your consent, processes your personal data using profiling. It is one of the forms of automated data processing, the purpose of which is to adapt the content addressed to you via the website to your individual preferences.
2. You consent to profiling when subscribing to the newsletter. If it is expressed, the algorithms collect information on the basis of which profiling takes place: information provided by you in the forms placed on the website and contained in cookies saved on your device. The information that may be contained in cookies, used for profiling, is: user ID, session ID, server ID, information about the time spent on a given website page.
3. Profiling results (e.g. in the form of product recommendations) will be displayed to you on the basis of previously collected information in cookies, including before registering for the newsletter. The correlation of data from cookies with the personal data provided by you on the forms on the website begins after subscribing to the newsletter and consenting to profiling.
